Exempt and Deemed Consent Advertisements
Some advertisements are exempt from council control if certain conditions are met, while others are deemed to have consent provided they conform to stated limitations and standard conditions.
Under the Regulations, some types of advertisement can be exempt from control by the council provided that certain conditions are met. Other specified categories of advertisement are deemed to be granted by the Regulations, commonly referred to as 'deemed consent', provided they conform to the stated limitations for each category and a schedule of standard conditions. It should also be noted that the Regulations provide the council with the power to make a direction withdrawing "deemed consent".
