Definition of Listed Building under Article 42(7) Planning Order 1991
A listed building includes the building itself plus objects or structures within its curtilage that are either fixed to it or formed part of the land since before 1 October 1973.
Further guidance to what can be included on the list is given in Article 42(7) of the 1991 Planning Order. This article explains that the term "listed building" refers to any building included in the list and that the following is also treated as part of the building: (a) any object or structure within the curtilage of the building and fixed to the building; and (b) any object or structure within the curtilage of the building which, although not fixed to the building, forms part of the land and has done so since before 1 October 1973.
