Definition of Availability

A site is considered available for development when there is confidence that no legal or ownership problems exist, such as multiple ownerships, ransom strips, tenancies, or operational requirements. Applicants must submit evidence of any insurmountable legal or ownership problems.

Availability This refers to sites that are available now or are likely to become available for development within a reasonable period of time. A site will be considered available for development when, on the best information available (such as searches), there is confidence that there are no legal or ownership problems, such as multiple ownerships, ransom strips, tenancies or operational requirements of landowners. Where sites become available unexpectedly after receipt of a planning application, the council will take this into account in its assessment of the application. Applicants will be required to submit evidence of any insurmountable legal or ownership problems that renders a site "unavailable".
