Time limit for spending commuted sums with return provisions

If commuted sums are not spent or committed to be spent within 7 years of receipt, the contribution must be returned to the developer adjusted for interest accrued over that period.

If following a total of 7 years from receipt, the contribution has not been spent or committed to be spent, it will be returned to the developer at a rate adjusted to reflect interest accrued over the 7 years. This is consistent with the time periods applied to other forms of developer contribution as set out in the Council's Developer Contributions Framework.
