Avoiding threshold avoidance through deliberate design

The Council will scrutinize proposals designed to stay below Policy HOU5 thresholds, particularly where sites are zoned for housing, multiple applications from the same applicant are made nearby, or adjoining lands are in common or coordinated ownership.

The Council will be alert to proposals that seek to avoid the requirements of Policy HOU5, being deliberately designed to remain below the threshold when they would otherwise be promoted as larger schemes. This has been taken into account in the wording of Policy HOU5. This issue is likely to arise in cases where, for example: • The site is zoned for housing and adjoins a broader area of residential zoning; • The subject site has another similar planning application for residential development from the same applicant in close proximity; or • The subject site and surrounding lands are in the same ownership, or are divided into multiple ownership in advance of making a planning application.
