Development in Controlled Reservoir Inundation Areas

Development within a controlled reservoir's inundation area is acceptable if a competent reservoirs engineer certifies the reservoir's condition, management and maintenance are appropriate for safety. In exceptional cases where assurance cannot be provided but remedial works are planned, negative planning conditions may be considered if other aspects are acceptable.

Development within the inundation area of a controlled reservoir will be acceptable in cases where certification has been provided from a competent reservoirs engineer that the condition, management and maintenance regime of the reservoir are appropriate to provide assurance regarding reservoir safety. Exceptionally, in cases where such assurance cannot be provided, but works are proposed or scheduled to the reservoir in question to bring it to a satisfactory state, the Council, in consultation with DfI Rivers, may consider the use of negative planning conditions where all other aspects of the development scheme are acceptable.
