Disproportionality Test for Major Renovation Works

An applicant may demonstrate that compliance with regulation 77B is disproportionate where the cost of compliance would be unreasonable relative to the work required and available alternative broadband delivery methods.

In relation to regulation 77A(2)(c), an example of a case of major renovation works where the cost of compliance with regulation 77B would be disproportionate to the benefit gained, would be one where the applicant can clearly demonstrate to the district council that in the particular case, the cost of compliance would be unreasonable, taking into account the work required and the available alternative means of high-speed broadband delivery.
