Category A Waste Facility Controls and Exemptions

Category A waste facilities are subject to additional regulatory controls. Applicants can request exemptions or reductions to Mine Waste Plan requirements if the waste is low risk to environment or human health, or if the application falls outside identified categories.

For a waste facility, the Regulations also set out a definition of a Category A waste facility, which is subject to additional controls set out in the Regulations. Where the application does not fall within the identified categories set out in the Regulations, the applicant will be required to apply for an exemption from the requirement to produce a Mine Waste Plan. Where the application does fall within the identified categories, but the type of waste is such that it is considered to be of low risk to the environment or human health the applicant can also apply for a reduction or waiver in relation to the requirements of a Mine Waste Plan.
