European Protected Species

Development likely to adversely affect European protected species will not be permitted unless there is no satisfactory alternative, it serves overriding public interest, the species population is not detrimentally affected, and compensatory measures are agreed and secured.

Development that is likely to have an adverse effect on a European protected species will not be permitted unless it can be demonstrated that: (a) There is no satisfactory alternative; (b) The development is required in the interests of public health or public safety, or for other imperative reasons of overriding public interest, including those of a social and economic nature and beneficial consequences of primary importance to the environment; (c) There is no detriment to the maintenance of the population of the species at a favourable conservation status; and (d) Compensatory measures are agreed and their delivery secured.
