Demonstrating Compliance of Untested Properties
After a failed test, the developer must demonstrate that properties not yet tested meet the performance standards, though once occupied any further action becomes a matter of local negotiation.
A failed set of tests raises questions over properties between which tests have not been carried out. The developer should demonstrate to the district council's satisfaction that such properties meet the performance standards. Once a dwelling or room for residential purposes is occupied, any action affecting it should be a matter for local negotiation.
