Regulation 40: Target carbon dioxide Emission Rate
Buildings must be designed and constructed to not exceed their Target carbon dioxide Emission Rate (TER), calculated using Department-approved National Calculation Methodology software for buildings other than dwellings.
It is the view of the Department that the requirements of regulation 40 will be met when a building is designed and constructed so as not to exceed its Target carbon dioxide Emission Rate (TER). The TER must be calculated using one of the types of software approved by the Department as a National Calculation Methodology for buildings other than dwellings. Regulation 40 implements Articles 3 and 4 of Directive 2010/31/EU of the European Parliament and of the Council of 19 May 2010 on the energy performance of buildings.
