District council powers for contamination - radon and discovery during construction
The district council actively enforces radon resistance measures in dwellings in designated radon-affected areas. If contamination is discovered during building work, the council can require remediation to make the site suitable for the development.
The only active use of the district council's power to deal with contaminants is in relation to the risk of radon ingress in dwellings where dwellings in a designated radon affected area are required to have measures incorporated to resist the ingress of radon.
Where, in exceptional circumstances, contamination of a site is only discovered during the building process, regulation 26(1)(b) empowers the district council to require the site to be remediated to a state suitable for the proposed development.
