Application of regulation 26(1) - presumption of clean sites
Building control assumes sites are free from contaminants unless contamination was identified and remediated before construction begins, or was never present.
The application of regulation 26(1) is based on the presumption that the area of the land within the boundary of the site will be free from contaminants. It may be that the site was not contaminated or any identified contamination was remediated prior to commencement of construction of the building.
