Compliance with Marine Policy Statement and Marine Plans

Planning authorities, particularly those with an interface with the marine area, must ensure that authorisation or enforcement decisions affecting the UK marine area comply with the Marine Policy Statement or Marine Plan once adopted, unless relevant considerations indicate otherwise.

Of particular relevance to planning authorities, particularly those with an interface with the marine area, is the current legislative requirement that all public authorities taking authorisation or enforcement decisions that affect or might affect the UK marine area must do so in accordance with the Marine Policy Statement (MPS) or Marine Plan once adopted, unless relevant considerations indicate otherwise. If it is not an authorisation decision then the public authority must have regard to the MPS or Marine Plan once adopted.
