Restrictions on Permitted Development Rights
Permitted development rights are more restrictive in designated areas such as conservation areas and areas of outstanding natural beauty, and for certain properties such as listed buildings; rights may also be removed by condition or already exhausted.
Permitted development rights are complex and sometimes more restrictive in designated areas, such as, conservation areas and areas of outstanding natural beauty; and for certain properties, such as listed buildings. It may also be the case that in some instances permitted development rights have been removed from a property by condition or have already been used and you should clarify this with your local planning office before proceeding with any proposal. If you consider the works you propose to carry out are permitted development you are advised to apply formally to your local planning office (see Annex C) for a Certificate of Lawful Use or Development before proceeding with the development. Such an application should be made using the appropriate form (LDC1) together with accompanying location map, plans and fee. Full details about the information required are listed on the application form and accompanying guidance notes. Advice on the necessary fee can be obtained from your local planning office or the Planning Service website www.planningni.gov.uk.
