Protection of Employment from Non-Planning Legislation Impacts

The Department may refuse planning permission for new development to protect existing employment where non-planning legislation (public health, environmental pollution) would impose costly requirements on established businesses due to new neighbouring development.

The requirements of non-planning legislation, for example those relating to public health and environmental pollution, may result in costly new requirements and restrictions being imposed on such businesses as a consequence of new neighbouring development. In such circumstances, the Department may refuse planning permission for new development in order to avoid jeopardising employment in the existing enterprise.
