Planning Conditions and Agreements for Public Benefits

Planning conditions or agreements under Article 40 of the Planning (Northern Ireland) Order 1991 may be required to secure delivery of public benefits and long-term management arrangements, determined during pre-application discussions.

In some instances, planning conditions attached to a permission will be sufficient to ensure that the public benefits are delivered. In other, more complex cases, and where there is a need to secure the long-term management arrangements, a planning agreement as set out in Article 40 of the Planning (Northern Ireland) Order 1991 will be required. The pre-application process will assist in identifying which option is best suited to the particular proposal.
