PPS 15 Planning and Flood Risk (Revised)·Page 27·Policy FLD 1 - Exceptions - Defended Areas

Exception: Defended Areas - Previously Developed Land

Previously developed land protected by structurally adequate flood defences providing minimum 1 in 100 year fluvial or 1 in 200 year coastal protection may be permitted, with restrictions on essential infrastructure, hazardous substances, vulnerable groups, and close proximity to defences.

a) Development of previously developed land protected by flood defences that are confirmed by DARD, as the competent authority, as structurally adequate and provide a minimum standard of 1 in 100 year fluvial or 1 in 200 year coastal flood protection. • Due to the residual flood risk there will be a presumption against development where proposals include essential infrastructure, storage of hazardous substances, bespoke accommodation for vulnerable groups or development located close to flood defences. • Proposals involving significant intensification of use will be considered on their individual merits and will be informed by the Flood Risk Assessment.
