Distinction between Planning and Licensing Control

Planning and licensing are separate regulatory regimes. The planning authority addresses planning aspects only, while licensing authorities consider additional matters such as need and social issues.

The two forms of control, planning and licensing, are quite distinct and should not be confused. The council's Planning Service will deal only with those aspects of the proposal which are relevant to planning. Since the 1985 Act allows the licensing authority to consider matters such as the need for new premises having regard to the facilities already existing and social issues, the local planning authority takes the view that planning powers should not duplicate the provisions of other legislation.
