Restaurants, cafés and hot food takeaways below or adjacent to residential units present amenity concerns. Hot food takeaways are particularly problematic due to late night operation and difficult-to-mitigate patron noise, while restaurants and cafés may be more acceptable due to controlled hours and lack of late-night operation.

Proposed restaurants, cafés and in particular hot food takeaways below or adjacent to existing residential units can present significant amenity concerns. Hot food takeaways due to their late night operation are likely to result in intermittent adverse impact on amenity as control of patron noise in particular will be difficult to mitigate and manage. Restaurants and cafés may be considered a more acceptable use in such close proximity to residential units, as the hours of operation can be controlled and by their nature, these premises do not tend to operate late at night.
