Definition of Hot Food Takeaway
A hot food takeaway is an establishment whose primary function is the sale of hot food for consumption off the premises. It is classified as a Sui Generis use under planning law and does not fall within any use class of the Planning (Use Classes) Order (Northern Ireland) 2015.
A hot food takeaway is an establishment, the primary function of which is the sale of hot food for consumption off the premises. Although commercial in nature, hot food takeaways do not fall within any use class of the Planning (Use Classes) Order (Northern Ireland) 2015 and are considered a Sui Generis use. It is therefore a form of development for which further guidance and clarification is appropriate to ensure the unique nature of the development can be adequately assessed.
