Definition of Restaurants and Cafés

Restaurants and cafés are defined as establishments whose primary function is the sale of hot food and drinks for consumption on the premises. They are classified as Sui Generis uses under planning law and do not fall within any use class of the Planning (Use Classes) Order (Northern Ireland) 2015.

The primary function of restaurants and cafés is the sale of hot food and drinks for consumption on the premises. Although commercial in nature, restaurants and cafés do not fall within any use class of the Planning (Use Classes) Order (Northern Ireland) 2015 and are considered a Sui Generis use. Restaurants and cafés are therefore forms of development for which further guidance and clarification is appropriate, to ensure their unique nature can be adequately assessed.
